Vietnam top legislators green-light joining of Abolition of Forced Labor Convention

Vietnam’s s participation in Convention 105 will contribute to the implementation of Vietnam’s foreign policy of international integration.

Vietnam plans to join Convention 105 (C105) on the abolition of forced labor, one of the core conventions of the International Labor Organization (ILO), the Government Portal cited National Assembly (NA) Standing Committee’s conclusions of its 44th session on April 28.

The Standing Committee agreed on the necessity to join the convention as it has implications on all political, socio-economic and legal aspects of Vietnam.

The country’s adherence to C105 will not change Vietnam’s international obligations as the country has already joined the ILO’s Convention No. 29 on Forced Labour since 2007.

Moreover, C105’s standards have been incorporated into Vietnam’s commitments under EU-Vietnam Free Trade Agreement (EVFTA) and Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP).

Minister of Labor, Invalids and Social Affairs Dao Ngoc Dung said Vietnam’s participation in the convention was in accordance with the Party’s guidelines to ensure human and civil rights. I demonstrated Vietnam’s political commitment to implementing obligations as an ILO member state and new generation free trade agreements.

He noted that the country’s participation in C105 will contribute to the implementation of Vietnam’s foreign policy of international integration.

Vietnam should join C105 to fulfill the obligations of an ILO member. According to the 1998 ILO Declaration, ILO member countries, whether they have acceded to the eight fundamental ILO Conventions or not, including C105, are obliged to implement the labor standards provided for in these conventions, the minister stressed.

“The non-use of forced labor in producing goods and services is considered a component of the ‘laissez-passer’, helping Vietnamese goods and services access global markets, especially those of the EU and the US,” Dung said.

Concluding the 44th session, NA Permanent Vice Chairwoman Tong Thi Phong said the NA Standing Committee agreed to apply the convention directly, without reservation of terms, and develop the ratification of the convention in three languages (Vietnamese, English and French).

Phong requested the government to ensure effective implementation of the convention, enhance the workforce training and labor inspection as well as secure the rights of Vietnamese workers.

Vietnam to apply online health check nationwide

Patient health record will be shared among medical examination and treatment facilities at all levels, thus helping patients to continue their treatment at different health centers.

Vietnam plans to activate a nationwide system for booking online medical examination and treatment from July 1, according to Minister of Health Nguyen Thanh Long.

Long stressed that hospitals across the country need to integrate into this system as soon as possible.

Some healthcare centers in Vietnam have applied the solution for a few years, but only as an individual effort, Long noted, adding that patients still have to queue at hospitals from 4:00 to 5:00 am for a medical check-up at hospitals.

Over the past time, the Ministry of Health has worked with software businesses to come up with a system for medical examination and treatment scheduling.

“This solution will help patients avoid going to hospitals several times a month”, Minister Nguyen Thanh Long emphasized.

Accordingly, patient health record will be shared among medical examination and treatment facilities at all levels, thus helping patients to continue their treatment at different health centers.

All the data will be managed by the ministry, Long said, adding that the system needs to integrate the function of online Covid-19 medical declaration for people who have been to the medical facilities to save time and avoid stasis at health centers.

“We will select a number of localities and health centers to pilot this system, then make a specific assessment before replicating the solution nationwide,” said Long.

US newspaper highlights Vietnam’s success in completing new leadership

Online sale apps are spending big money on promotion campaigns to retain consumers, but the money seems to have been spent in vain.

In order to buy a body care lotion bottle at a preferential price from a sale promotion program, Tran Thanh Truc in Ba Dinh district, Hanoi, installed a shopping app. Buying the product via this app, she enjoyed a discount of VND50,000 and did not have to pay a delivery fee under the new membership program.

One month after the purchase, Truc removed the app from her smartphone because she no longer wanted to buy things via this app.

Consumers like Truc are potential clients targeted by shopping apps. They compare selling prices offered by suppliers and choose the ones with lowest price levels. They are willing to shift to use other apps if the apps offer more attractive prices.

With the principle ‘new one in, old one out’, they are not loyal clients.

Nguyen Thi Hoai, a housewife in Hanoi, said she often installs new shopping apps. She noticed that sale promotion programs tend to target new customers rather than loyal clients.

“I am the manager of our family’s coffers, so I try to save every dong. I always compare the prices quoted on different apps and I will give up the apps which no longer offer discounts for products and set high delivery fees,” she said.

With the habit of saving every dong, Vietnamese consumers prefer COD (cash on delivery) payment, though online payments are convenient.

Hoai confirmed that she only makes online payments when there are promotion programs run by her e-wallet or Visa card.

When asked which app is her favorite, Hoai said that she doesn’t have one. She buys milk and napkins for kids via onr app, but chooses other apps for books and electronics.

Meanwhile, Do Quang Thang in Hanoi said he removed two apps because of bad quality of products and services.

“The products were advertised as having high quality, but they were really terrible,” he said.

Online sale apps are spending big money on promotion campaigns to retain consumers, but the money seems to have been spent in vain.

On consumers’ forums, people complain that the quality of products is not exact as advertised, and the service is not professional. And trade fraud is another problem. This explains why many people turn their back on online shopping and only buy things after seeing them with their eyes.

A representative of a shopping app said customers will delete unsuitable apps after trying. They install apps when the apps offer preferences, but if they don’t feel satisfied about the services, they will give up the apps because they have too many other choices.

The Southeast Asia e-commerce map of iPrice Group shows that the app removal rate in Vietnam is the highest in Southeast Asia, 49 percent in Q2 2020, though Vietnam was the second largest market in the region, after Indonesia in terms of access traffic.

The average number of visits to websites in Vietnam in 2020 was four times higher than Malaysia, three times more than the Philippines and twice as much as Thailand.

The race to win customers’ heart

In order to lure customers like Truc and Hoai, shopping apps spend billions of dong to make their apps known to customers and persuade them to install the apps. And in order to retain them, they run promotion campaigns continuously and compete with each other every minute.

Lazada, Shopee, Tiki and Sendo, the ‘big four’ in Vietnam’s e-commerce market, ran big sale promotion programs in 2020, on Single’s Day on November 11, Black Friday on November 27, Cyber Monday on November 30, December 12 and others.

Market analysts say that consumer psychology influences buying habits. As the Covid-19 pandemic has been controlled well in Vietnam, consumers are returning to do more shopping.

iPrice suggested that in addition to running sale promotion programs to attract customers, e-commerce firms should think of measures to improve customers’ experience.

E-commerce platforms will get big benefits if using AI and Big Data which gives better recognition to customers, understands their tastes and makes reasonable suggestions to them.

Tran Tuan Anh, managing director of Shopee Vietnam, said when people stay home during social distancing campaigns, they tend to shift to online platforms, which allows them to both satisfy their daily needs and use for entertainment purposes.

E-commerce apps need to integrate many factors for interaction, including games and livestreams to improve connections with consumers.

Vu Duc Thinh, CEO of Lazada Logistics Vietnam, said Lazada will continue to use technological resources and initiative to optimize customer’s experiences. In addition, it will shorten the time needed for north-south deliveries, striving for within-day delivery service at the lowest possible cost.

At present, e-commerce platforms are still taking a loss. They accept this because they have high hopes for the Vietnamese e-commerce market, which is predicted to have the value of $29 billion by 2025.

Google predicts that Vietnam’s e-commerce will obtain the highest growth rate, 34 percent, in the region by 2025.

The entry into force of the European Union’s General Data Protection Regulation (GDPR) in May 2018 was a wake-up call for companies in Vietnam which have business relationships with EU-based companies or employ EU citizens. The main reason was because the GDPR has an extraterritorial effect under which the supervisory authority of each member state of the EU is empowered to penalise non-EU companies violating the GDPR while having business transactions with EU individuals or companies.

Using a model similar to the GDPR in sanctioning the non-compliance activities, the highest level of fine might be calculated based on the annual turnover of the violator of the preceding financial year. The draft decree on personal data protection (DPDP) is therefore foreseen to have a significant impact on all businesses operating in Vietnam, especially foreign-invested enterprises (FIEs) which often have cross-border data transfer activities.

The personal data protection (PDP) committee is an independent governmental body to be established under the auspices of the Ministry of Public Security (MoPS) of Vietnam. The PDP committee will function as the supervisory authority which oversees PDP activities in Vietnam.

Some of its duties include developing and running a national portal of personal data protection; approving data privacy policies of companies and organisations before they are rolled out; examining registration dossiers for the processing of sensitive personal data and transferring personal data cross border and requesting the MoPS to approve or reject the registration dossiers; requesting the MoPS to inspect suspected violations in PDP activities or to sanction the violations; issuing guidelines to implement the DPDP; and proposing inspection plans to the MoPS which might be conducted maximum twice a year, save for the case of a manifest violation.

Sensitive personal data

The definition of sensitive personal data is introduced for the first time in Vietnam by the MoPS to distinguish between that and the definition of basic personal data. Sensitive personal data includes genetic and biometric data, data concerning health, gender, sexual orientation, financial status and income, criminal records, location, and social relations of an individual.

According to the draft DPDP, the list of sensitive personal data is not an exhaustive one as any signature data of a person which requires a high level of confidentiality and special protection of the laws will be considered as sensitive personal data. Due to this special characteristic of the sensitive personal data, any processor wishing to process such data must register the data with the PDP committee in advance, save for certain exceptional circumstances.

The registration process would take maximum 20 working days from the date the PDP committee receives a sufficient registration dossier. Violation of the registration requirement might expose the processor to a fine of up to $4,300. Fintech companies, banks, hospitals, fitness centres and healthcare clinics would be the first ones that would get hit by this regulation when the DPDP takes effect.

According to the draft DPDP, cross-border transfer of personal data of Vietnamese citizens is restricted to a large extent. Specifically, cross-border transfer is conditional upon the satisfaction of four elements: the data subject consented to the transfer; the original data is stored in Vietnam; the country or the state where the data recipient is based offers the same or a higher level of data protection in comparison with Vietnam; and the PDP committee approves the transfer.

Although the draft DPDP sets out an exception where the cross-border transfer would be permissible without satisfying the four aforesaid elements, the prerequisites for this exceptional case need to be clarified in the subsequent drafts of the DPDP as they are still very obscure in this draft.

It is worth noting that in respect to the fourth element as set forth above, it would take a maximum of 20 working days to obtain an approval from the PDP committee after a sufficient registration dossier is lodged. Again, violation of the aforesaid requirement regarding cross-border transfer might expose the data transferor to a fine of up to $4,300.

As FIEs, as well as branches and representative offices of foreign investors in Vietnam, are often involved in multiple cross-border transfer activities, the draft DPDP proposes to apply a very severe fine, being 5 per cent of the total revenue in Vietnam, to violators of the regulation.

Additional requirements

Similar to the concept of data controller in the GDPR, the draft DPDP requires a company or organisation which conducts data processing to set up or designate an internal department to function as a personal data protection department; and appoint a data protection office.

The main responsibilities of the PDP department and the data protection officer are to supervise activities within the organisation and to be the contact point for liaison with the PDP committee. The contact details of such department and officer must be notified to the committee.

The draft DPDP also requires a company or organisation which conducts data processing to issue a policy on PDP and applicable templates in implementation of the DPDP; and internal regulations governing the process of handling complaints and whistle-blowing reports with regard to personal data protection.

Last but not least, the draft DPDP requires a company or organisation which conducts cross-border transfer of personal data to store the records containing the timing of the transfer, recipient identity and contact details, and nature and volume of the data transferred within three years from the date of the transfer.

The draft DPDP sets out different types of administrative sanctions against violations of PDP, for example monetary penalty, suspension of personal data processing, or revocation of the rights for processing sensitive personal data and cross-border transfer of personal data. Some of these have been mentioned before.

Of note, similar to GDPR, the draft DPDP proposes to apply a very severe fine, being 5 per cent of the total revenue in Vietnam, to violators of the DPDP.

Although the draft is still in the process of being completed, given the fact that it is proposed to take effect in December, both local and foreign-invested enterprises should develop action plans as soon as possible to address new requirements imposed by the DPDP, for instance an internal policy regarding data protection, and setting up a department and appointing a data protection officer to oversee and censor data processing activities within the company.

This might require the involvement and collaboration of different departments in a company such as legal, HR, IT, and finance. Companies and organisations operating in Vietnam should keep the developments of the draft DPDP on the radar in the coming months.

Ao Dai for men in Vietnamese cultural flow

The traditional costumes have always contributed to honouring the country’s cultural identities. The men’s Ao Dai had once sunk into oblivion. However, today, Ao Dai for men is in the process of a renaissance, with the attention of the whole community.

An arduous journey

People who love traditional culture must not forget the image of Vietnamese Ambassador to the United Kingdom (UK) Tran Ngoc An presenting a letter of credentials to UK Queen Elizabeth II. He wore a blue Ao Dai with traditional patterns. That was a beautiful moment as Ambassador Tran Ngoc An selecteda Ao Dai to express Vietnamese traditional culture. Vietnamese Ambassador to India, Bhutan and Nepal Pham Sanh chau wore Ao Dai not only during diplomatic ceremonies but also at festivals and cultural events. He also mobilised the Embassy’s staff to wear Ao Dai regularly. Now all staff at the Vietnamese Embassy in India wear Ao Dai on three occasions each year including at Tet (Lunar New Year), National Holidays and the Vu Lan (a Buddhist holiday held annually on the 15th day of the 7th lunar month to express gratitude to mothers). Ambassador Chau has been called “The Ambassador of Ao Dai ”. The appearance of Ao Dai for men at diplomatic events has surprised many people because previously, few people thought this kind of traditional long dress could bring such elegance and honour to the national culture.

These beautiful images make us feel the revival of Ao Dai for men seems to have started. However, the return of men’s Ao Dai was not as easy as it seems. Writer and researcher Hoang Quoc Hai still remembers the time nearly 30 years ago when the Ministry of Culture and Information (now the Ministry of Culture, Sports and Tourism) invited experts to discuss national clothing. He said that none of the many invited cultural managers and experts could answer the question of what was the national uniform for men. For him, it is a cultural pain. He said the meeting between leaders of the Ministry of Culture and Information and experts did not bring about results as expected but it did create a start.

Many people started talking about a national dress that expresses the national identity firstly. Certainly, traditional Vietnamese clothing comes in a variety of styles for men and women. However, the traditional Ao Dai dress was considered the “prime candidate” for the national clothing of Vietnamese men. In the past, Ao Dai for men often appeared only on the stage or at festivals. But then, the Ao Dai for men gradually appeared more at weddings, fashion shows and cultural events. Images of the Ao Dai for men in use have been more frequent over the past ten years. There are more and more young people confidently wearing Ao Dai in their activities. Thua Thien Hue province has become the first locality encouraging male civil servants in the cultural sector to wear Ao Dai each Monday.

The journey of preserving and promoting the value of Ao Dai for men also featured the participation of many researchers, cultural experts and especially young people. Dinh Lang Viet (Vietnamese Communal House) Club is one group active in restoring the tradition of the men’s Ao Dai . Its members have always worn Ao Dai at cultural events. In 2017, the Ao Dai Ngu Than (five-flap long dress) Development Support Centre under the Dinh Lang Viet Club was formed. The club’s head Nguyen Duc Binh said that “Lord Nguyen Phuc Khoat laid the foundation for the birth and development of Ao Dai Ngu Than in 1744. The image of Ao Dai for men had faded since 1940s due to the influence of western culture. After 1954, Ao Dai for men only appeared on stage. Wars persisted continuously, so the image of Ao Dai was forgotten. In fact, in cultural and fashion festivals, many variations of Ao Dai sometimes lost the male visage of strength, sometimes looking like the traditional long dresses of other countries in the South Asia. Many people began to confuse the men’s Ao Dai with other outfits. This is the reason why the Dinh Lang Viet Club and many research groups and art experts started to rediscover the beauty of the men’s Ao Dai . Fortunately, there are still many documents and images related to the Ao Dai Ngu Than .

In addition to Dinh Lang Viet Club, many researchers and other traditional cultural clubs have conducted their own studies. Up to this point, the traditional Ao Dai for men has been “positioned” onspecial criteria. In addition to its distinguishing factors compared to the long dresses of other nations, Ao Dai for men has a distinctly profound significance. For example, the five flaps represent the four mothers and fathers as well as himself. Five buttons represent the five virtues of a gentleman.

Efforts to make Ao Dai closer to life

As a witness of the ups and downs of the men’s Ao Dai , writer Hoang Quoc Hai is happy to see its “renaissance”. He said that he has firm faith because there are many young people among the researchers and those who like wearing Ao Dai ngu than . In fact, in addition to Dinh Lang Viet Club, the Y Van Hien Club was a group of 9x young people who have made efforts to find a way back for the nation’s traditional costumes. Y Van Hien has become a reputable enterprise that specialises in providing traditional costumes for collectives and individuals including many cultural and diplomatic activists. Director of the Y Van Hien Company Nguyen Duc Loc said: “Looking back at the photos of Hanoians in the early twentieth century, we see that many Hanoi families wore traditional Ao Dai . The traditional Ao Dai for men overcomes many physical weaknesses while exuding an elegant elegance and demonstrating the strong poise of a man”.

However, the traditional Ao Dai for men has also certain disadvantages. The preservation and promotion of value of this traditional outfit is necessary; however, the problem is how to apply it to the modern social context.

According to Master Nguyen Kim Huong, a lecture from the Hanoi University of Architecture, the renovation of Ao Dai is a trend to suit today’s life, so that it can be used while going to work and going out”.

Many other researchers believe the renovation must pay attention to convenience and comfort. Head of Dinh Lang Viet Club Nguyen Duc Binh also noted that Ao Dai must be adjusted to keep its traditional beauty as well as apply it to today’s lifestyle.

Although there is no official document recognising the men’s Ao Dai ngu than as a national costume, in the minds of many people, it is most certainly a representative image of Vietnamese costume culture.
