V. League club lose another case in FIFA’s dispute resolution chamber

FIFA handed the win to Cisse after putting out a 10-page report of the arbitration, which said his claim is “admissible and partially accepted.” Accordingly, the club will have to pay Cisse $58,420 in compensation.

Thanh Hoa filed an appeal to the Court of Arbitration for Sport (CAS) after FIFA’s decision. The cost for this case will be $2,000 plus 1.5 percent of the disputed money ($58,420), according to CAS regulations.

Cisse came to Thanh Hoa for trial and signed with the club in November 2019 with a monthly salary of $8,500, plus a contract fee of $85,000 per year, half of which would be paid at the start of the season and the rest following the 25th round of the season.

Although Cisse said he had successfully completed his medical exam on Nov. 5, 2019, Nguyen Van De, the club’s president at the time, decided to end the contract with the 31-year-old on Jan. 7, 2020, stating his thigh injury would not heal in time for the new season.

According to Cisse, De met him on Dec. 31, 2019 to convince him to sign a mutual termination agreement but the player refused to do so. Then a week later, De told him that he is not allowed to train with the team or access team facilities. He also claimed he only received $3,000 of his November salary, and that his December 2019 and January 2020 salaries were still outstanding.

The club said they had terminated Cisse’s contract after his medical examination in November. They also claimed Cisse had breached the contract by submitting a complaint to Vietnam Football Federation and accused him of only attending a few training sessions since November 2019. They also quoted part of the contract, which reads:

“In case for any reason the Player does not maintain the level of playing skillfulness and/or physical conditions to the satisfaction of the Club, the Club on the sole basis of the opinion of the Club’s Professional Council and Training Board has the right to unilaterally reduce the salary, the bonus and other compliments or terminate this Contract without having to compensate the Player for such early contract termination.”

However, FIFA’s dispute resolution chamber concluded “the validity of a contract may not be subject to successful medical examinations and that a club wishing to employ a player has to exercise due diligence and carry out all relevant medical examinations prior to entering into an employment contract.” Therefore, the chamber decided the contract had been “tacitly terminated by the parties’ actions.”

Of the $58,420 Thanh Hoa have to pay Cisse, $42,500 equates to 50 percent of the contract fee ($85,000) he was supposed to receive when the season began, $5,500 for November salary, $8,500 for December and $1,920 for January, calculated until the date of contract termination.

FIFA also stated Thanh Hoa would have to pay Cisse within 45 days or they shall be banned from signing any new players, domestically or internationally for a maximum of three transfer windows or until the due amount is paid.

Thanh Hoa FC are also involved in another arbitration with Italian coach Fabio Lopez after sacking him without contract compensation last year. Lopez said FIFA has ruled him as the winner of this case and the expected amount that Thanh Hoa would have to pay him and his assistant is around $200,000.

V. League club agrees to compensate Italian coach

“We will follow FIFA’s verdict in this case,” Pham Nguyen Hong, director of Thanh Hoa Province Culture, Sport and Tourism Department and chairman of Thanh Hoa Football Federation, said.

After being sacked by Thanh Hoa for underwhelming results at the start of V. League 2020, Lopez brought the arbitration to FIFA. The 47-year-old coach claimed Thanh Hoa had violated the two-year contract he signed with the club previously by not compensating him following its termination.

After nearly a year, FIFA awarded the case to Lopez and his assistant, forcing Thanh Hoa to pay them $187,000. The club will have to complete the payment within 45 days or be banned from signing any new players, domestically or internationally and in the worst case, demoted.

Thanh Hoa will not bring this case to the Court of Arbitration for Sport (CAS), since their winning chance is thin. If the club fails to make a case, they would have to pay another $30,000 in court fees. Previously, they filed an appeal against Senegalese player Idrissa Sega Cisse but lost. As a result, Thanh Hoa still had to pay Cisse $58,420 in compensation and $20,000 in court fees.

Thanh Hoa is currently waiting on Lopez to provide them the necessary details in order to complete the transaction.

The club’s new sponsor stated it would not pay for this case since it happened before it came on board. Therefore, the responsibility belongs to Thanh Hoa Football Federation.

Before coaching Thanh Hoa, Lopez had managed many academy squads for Italian clubs like Atalanta and ACF Fiorentina as well as clubs in Eastern Europe and Asia.

Three V. Leagues clubs request prioritized Covid-19 vaccination

On March 8, the first batch of AstraZeneca vaccines will be administered to groups prioritized by the Vietnam government, with athletes not included.

Vietnam Football JSC (VPF) has requested Viettel FC, Hanoi FC and Saigon FC players to be vaccinated before competing in Asian Football Confederation (AFC) tournaments abroad.

Viettel will compete in the group stage of AFC Champions League (ACL) with Thai club BG Pathum United, ACL title defender Ulsan Hyundai from South Korea and a play-off winner in Bangkok from April 21 to May 7.

In turn, Hanoi will play in the AFC Cup group stage with Indonesian side Bali United, Cambodian club Boeung Ket and a play-off winner. Saigon will compete in another group with Malaysia’s Kedah, Singaporean club Lion City Sailors and a play-off winner. The AFC Cup group stage will take place from June 22 to 28. While Hanoi’s group has still to nominate a venue, Saigon’s group will play in Singapore.

Previously, Saigon had expressed a desire to host their group games, but the requirement of 14 days in quarantine fell short of AFC stipulations requesting players to be isolated for no more than four days when competing in a foreign country.

Earlier, the government had approved a list of prioritized groups to be vaccinated against Covid-19, which included frontline workers, military, and police forces.

Others on the priority list are teachers, diplomatic personnel, customs and immigration officers, those working in essential services like transport, people aged 65 and above, and those with chronic diseases that make them more vulnerable to the disease.

Japanese club registers Vietnamese keeper for new season

In introducing Lam on their website, Osaka mention his 188 cm height and 88 kg weight as well as his playing history for V. League clubs like Hoang Anh Gia Lai, Hai Phong FC and Thai League club Muangthong United. They also include information about his international career, as Lam has represented the national U19 and U23 teams, and is now the main keeper for Vietnam’s national men’s team.

Also included in the list are two veteran goalkeepers, 34-year-old South Korean Kim Jin-hyeon and 36-year-old Japanese Kenya Matsui. Kim is currently the number one keeper for Osaka, having won the club’s jersey for a decade. Many believe that Lam is being considered a long-term replacement for Kim.

Osaka has registered 10 defenders, 10 attackers and nine midfielders for the new season. Lam is one of their four foreign players, the others being Brazilian center-back duo Tiago Pagnussat and Dankler Pereira, and Australia national team striker Adam Taggart. The club’s head coach is Brazilian Levir Culpi, who has managed many clubs in Brazil, including Santos and Fluminense.

The J1 League club has installed a locker room for Lam with his name on it. The 28-year-old is set to fly to Japan at the end of this month. He is currently training in Thailand.

Lam garnered media attention recently when he decided to end his contract with Muangthong United and move to Osaka. Muangthong has reported him to FIFA for contract violation, but Lam’s agent said the player has every right to terminate the contract since the Thai club cut his pay without telling him.

Osaka will play its first game of J1 League 2021 against Kashiwa Reysol on February 27.

V. League third most valuable championship in Southeast Asia

Transfermarkt valued 437 players of 14 clubs in V. League 2021 at €34.66 million ($42 million), up €1.76 million compared to the last season. The top three players boasting the highest league value are Vietnamese-American midfielder Lee Nguyen, Brazilian forward Pedro Paulo and Brazilian striker Bruno Cantanhede, at €415,000 each. The three players joined V. League clubs last month.

Placing above Vietnam is Liga Indonesia and Thai League. Although the top Indonesian league dropped €12.43 million compared to last year, it remains in second at €47.8 million. Thai League is the most valuable Southeast Asia championship at €67.33 million.

Following Vietnam closely in fourth is Malaysian Super League at €33.32 million. The highest spike in value involved Laos Premier League, which went from €580,000 last year to €6.58 million this year to peak at seventh.

At present, V. League 2021 remains postponed due to the recent outbreak of Covid-19 in Vietnam. If the situation is brought under control, the next three league rounds would resume in March. In April, four more rounds will take place, with clubs only allowed four days of rest between matches. All games are expected to commence behind closed doors.

The league will pause in May for the national team to prepare for the World Cup Asian qualifiers in June, before continuing in July.

Viettel FC to face Thai rivals in 2021 AFC Champions League

Viettel FC have been selected in the third seed group in East Asia, alongside United City of the Philippines, Johor Darul Ta’zim of Malaysia, Tampines Rovers of Singapore, and Kitchee of Hong Kong (China).

Elsewhere, BG Pathum United FC of Thailand are in the first seed group, whilst the other Thai club in the competition Port are in the second seed group.

This means Viettel FC are likely to play one of the Thai clubs in order to cruise into the next round.

The 40th iteration of the tournament features the participation of 40 teams from both East Asia and West Asia.

In total 20 teams from East Asia have been divided into five groups, with the five group winners and three second-placed teams set to progress through to the knock-out stage.

The draw for the AFC Champions League’s group matches is scheduled to be held on January 27 at the AFC’s headquarters in Malaysia.

Group matches will then be held from April 21 to May 7 with home and away games to take place in a specific venue.
